Terms of Sales

ARTICLE 1 – PREAMBLE

The present general conditions of sale (hereinafter referred to as the “General Conditions of Sale”) are applicable between :

  • The SPL “Le Pressoir” known as “Centre d’Interprétation Sensorielle des Vins de Champagne” (hereinafter referred to as “Pressoria”), recognized as a public utility by decree dated October 9, 2020, whose head office is located at 11 Boulevard Pierre Cheval in Aÿ-Champagne 51160,

And

  • Any individual or legal entity (hereinafter referred to as “the Customer”) purchasing a ticket to visit Pressoria on the website www.pressoria.com (hereinafter referred to as “the Site”).

The Customer is invited to carefully read the General Terms and Conditions of Sale, which aim to define the terms and conditions of ticket sales on the website www.pressoria.com. Any order implies full acceptance of these conditions by the Customer, who acknowledges having read them, prior to the validation of his purchase.

ARTICLE 2 – DEFINITIONS

All terms defined below beginning with a capital letter, whether used in the singular or plural, shall have the following meaning in the context of the General Terms and Conditions of Sale:

  • Ticket”: means the entry ticket entitling one person to a single entry to Pressoria or, in the case of the Family Ticket, a single entry for 4 people; or the voucher proving that a person has taken out an annual subscription to visit Pressoria purchased by the Customer on the Site,
  • Customer”: means any consumer who purchases a Ticket on the Site and who has accepted the General Terms and Conditions of Sale in accordance with the terms and conditions set forth in Article 3 below,
  • Order”: means any contract between the Customer and Pressoria allowing the purchase of one or more products,
    – Order”: any contract between the Customer and Pressoria enabling the Customer to subscribe to one or more products,
  • Price List”: means Pressoria’s price list on the Internet site under the heading “Ticketing”,
  • Pressoria”: refers to SPL Le Pressoir located at 11 boulevard Pierre Cheval in Aÿ-Champagne and all the activities offered there, whether regular (tour of the scenography and tasting) or exceptional (any event organized for a particular occasion, expressly stipulated at the time of the Order by the Customer),
  • Site”: refers to the Internet site www.pressoria.com and all the pages attached to it.

ARTICLE 3 – SCOPE OF APPLICATION

These general terms and conditions of sale shall apply as of right to all services sold or offered for sale by Pressoria.
They shall apply to sales made only on the Pressoria website. Pressoria reserves the right to modify these terms and conditions at any time, without prior notice, it being understood that such modifications shall be inapplicable to reservations made prior to such modifications.
These terms and conditions are applicable from the date of opening to the public of the establishment, July 2, 2021.
Any order or purchase implies unreserved acceptance of these terms and conditions of sale, which prevail over all other terms and conditions, except for those expressly accepted by the seller and included in the reservation contract.

Pressoria shall not be liable for the terms and conditions of sale of any external service provider used by the Customer. The Customer undertakes to have taken cognizance of the terms and conditions of sale of any external service providers that he may have requested and shall not hold Pressoria liable in the event of any claim.

ARTICLE 4 – PURCHASE CONDITIONS

4.1 – TERMS OF PURCHASE

The order shall be placed via the Internet on the Pressoria website at the following address: www.pressoria.com
To place an order, the Customer is invited to fill in a registration form containing the following information: surname, first name, title, e-mail address, telephone number, date of birth, postal address (optional). The Customer agrees to provide the necessary, complete and accurate information and, if necessary, to update it in case of subsequent changes.
Sales are processed within the limits of the quotas allocated to an offer. In fact, they can vary in real time. If the buyer does not receive confirmation or cancellation of his order by e-mail within one day or twenty-four (24) hours, he must contact Pressoria by telephone at 03.26.77.98.77.
For any order on the Site, the Customer undertakes to fill in the order form, taking care to provide the necessary, complete and accurate information.
After visiting the page dedicated to Ticketing on the Pressoria Website, the Customer selects the type of Tickets he/she wishes to order by clicking on the drop-down list in the “Option” section and enters the number of Tickets when placing the online Order. He undertakes to check his entire Order before proceeding with payment.
When the Tickets are delivered, the purchaser must check that they comply with his Order. In accordance with the provisions of Article l.121-21-8 of the French Consumer Code, the buyer does not have the right of withdrawal.
The Customer may obtain a voucher allowing free access or certain Tickets at a preferential rate via the Site, with presentation of a receipt at the ticket office on the day of the visit.
The Customer acknowledges that he/she is aware of the services, price reductions and, where applicable, free tickets to which he/she may be entitled for his/her visit via the Website in the “Options” section when he/she places the Order. The services, price reductions or freebies available on the Web site may differ from the services, price reductions or freebies that may be obtained by the Customer directly at the ticket office on the day of the visit. By accepting these General Terms and Conditions of Sale, the Orders are subject to the present General Terms and Conditions of Sale as well as to Pressoria’s internal regulations, which are available on request at Pressoria’s reception desk.

4.2 – TERMS AND CONDITIONS OF ACCEPTANCE OF THE GENERAL TERMS OF SALE

By clicking on “Validate” at the end of the order process and by checking the box “I accept the General Terms and Conditions of Sale”, the Customer declares that he/she has read and accepted, without reservation, the entire General Terms and Conditions of Sale.

4.3 – TERMS OF PAYMENT

The price of the Tickets is quoted inclusive of all taxes, in euros (€) and payable in that currency only. The price of the Tickets is indicated on the Site or at the Pressoria ticket office.
Online payment is made by Visa or MasterCard, using the Bancontact platform.
In the case of payment via the Bancontact platform, the Customer will be redirected to the platform and must refer to the Terms of Use of the said platform. Pressoria shall not be held responsible for the proper processing of the payment.
Once the Order has been verified and the General Terms and Conditions of Sale have been accepted in accordance with the above conditions, the Customer shall be redirected to a secure payment server where he/she shall make the online payment of the Order using his/her credit card details, which shall include the number, expiry date and security code on the back of the card.
The amount of the Order shall be debited from the Customer’s bank account as soon as the transaction is finally validated on the Web site. The debit of the bank card is independent of the printing of the Tickets.
In the event of a payment rejection by the payment center, the transaction is automatically cancelled. Any online purchase is firm and final, and no cancellation or modification of the order by the Customer is possible once payment has been confirmed.
Upon completion of the Order, the Customer will receive a purchase confirmation e-mail (transaction receipt), sent automatically by the secure payment system. The transaction receipt includes:

  • The Customer’s contact details as indicated at the time of booking,
  • Pressoria’s contact information,
  • The summary of the order; number of tickets, their unit amount and the total amount paid by the Customer
  • The date, time and amount of the transaction.

This e-mail does not have the value of a Ticket, which will be delivered in accordance with the conditions set out in article 5.3 “Delivery of Tickets” below.

ARTICLE 5 – TICKETS

5.1 – RESTRICTIONS ON THE USE OF TICKETS

Subject to the provisions of article 4.1 of the General Terms and Conditions of Sale, no Ticket may be taken back, exchanged or refunded.
Any reproduction or resale of the Ticket is strictly prohibited.
The annual subscription allows access to Pressoria only once a day (see article 6.1)
Each Ticket gives access only once to the scenographic tour and tasting or to any other activity offered by Pressoria, any exit from these areas being final.

5.2 – PRICE OF TICKETS

The price of the Tickets is indicated including all taxes in euros (€) and is payable in this currency only. The price of the Tickets is indicated on the Site or at the Pressoria ticket office.
The applicable price is the one in force on the day of the order by the Customer.

5.3 – DELIVERY OF TICKETS

The printout of the purchase confirmation e-mail sent by Pressoria to the Customer does not constitute a Ticket. Under no circumstances may this document be used as a Ticket and allow access to Pressoria.
Dated Tickets, countermarks proving the purchase of an annual subscription or a Gift Card can be printed out at home by the Customer until the date of his visit by clicking on the link in the purchase confirmation e-mail.
For countermarks, please refer to articles 6 and 7 of these General Terms and Conditions of Sale.
To be valid, the Dated Ticket must be printed in one (1) copy on white A4 paper, blank on both sides. Good quality printing is required. Partially printed, soiled, damaged or illegible Tickets will not be accepted and will be considered invalid. In order to verify the quality of the printing, the Customer must ensure that the information on the Ticket and the barcode are legible at the time of the visit.
In case of omission, a duplicate can be printed at the Pressoria counter. In order to reprint the Ticket, the Customer must be in possession of the identifier and the date of the reservation, as indicated in the purchase confirmation e-mail, and a piece of identification of the Customer, as recorded on the Site at the time the order was taken.
Tickets that can be downloaded to cell phones (m-tickets) are also accepted.
Each Ticket has a unique bar code allowing access to Pressoria.
In the event of loss or theft of a Ticket or duplication of a Ticket, only the first person presenting such Ticket shall be deemed to be the legitimate bearer of the Ticket and shall have access to Pressoria.

Pressoria shall in no event be liable for lost or stolen Tickets. However, a duplicate may be issued at the cashier’s desk upon presentation of identification and indication of the reservation ID and date, provided that the Ticket has not been previously used.

ARTICLE 6 – ANNUAL SUBSCRIPTION

6.1 – ORDERING AND USING THE ANNUAL SUBSCRIPTION

An annual subscription may be ordered on the Pressoria Site. The annual subscription entitles the holder to unlimited visiting rights for a period of one (1) year from the date of first use of the subscription and within the limit of one use per day. This subscription is strictly nominative and may not be transferred or resold under any circumstances. Pressoria reserves the right to ask for proof of identity from the holder of an annual subscription when visiting the site.
The annual subscription offers are as follows:

  • 36€ for a nominative subscription, valid for one adult for a period of one (1) year from the date of first use,
  • 19,50€ for a nominative subscription, valid for a child from 6 to 18 years old at the time of subscription, for a period of one (1) year from the date of first use,
  • 65€ for a ” duo subscription “, valid for two adults for a period of one (1) year from the date of first use,

If the Order is placed by the Customer via Pressoria’s website, the Customer shall be required to print the counterfoil received by e-mail following his/her Order in order to present it at the Pressoria counter during his/her first visit. The customer will then be given a card valid for one (1) year from the date of this exchange.
The annual subscription is valid only for access to the permanent exhibition of Pressoria. It cannot be used to access the tasting area only.
For any temporary and/or exceptional activity organized within Pressoria, including additional services to the access to the permanent exhibition and its tasting space, the customer holding the annual subscription benefits from a 20% reduction on the public rate proposed for exceptional events.
For all purchases in the boutique, excluding Lalique, the bookstore and the bar-restaurant area, the Annual Passholder receives a 10% discount.

ARTICLE 8 – CONDITIONS FOR GROUP VISITS

8.1 – DEFINITION OF GROUP RATES

A group is defined as a group of more than twenty-one (21) visitors who visit Pressoria on the same day and at the same time.
The group rate is fourteen (14) euros per person. One free ticket is granted for every twenty (20) tickets purchased.
For practical and technical reasons and if the group is larger than thirty (30) participants, Pressoria reserves the right to split the group in order to organize departures for the visit delayed by thirty (30) minutes.

8.2 – BOOKING CONDITIONS AND PAYMENT

If the Order is placed via the website, the Customer shall reserve and pay for the Tickets in full online.
In accordance with article L.221-28 of the French Consumer Code. Tickets are therefore non-refundable. For any change of date/time, the Customer must contact Pressoria by e-mail or telephone.

ARTICLE 9 – TERMS OF REIMBURSEMENT

9.1 – NO RIGHT OF RETRACTION

As the sale of Tickets for the visit of Pressoria constitutes a service of leisure activities to be provided on a specific date or during a specific period, in accordance with the provisions of article L.221-28 of the French Consumer Code, the consumer’s right of withdrawal is not applicable to the purchase of Tickets. Any validated and paid Order will not be eligible for a refund in case of cancellation.

9.2 – PARTIAL OR TOTAL CLOSURE BEFORE THE START OF THE VISIT

Pressoria may have to restrict the opening hours or close all or part of its premises. In the latter case, and to the extent that the Customer can justify his inability to return at a later date, the value of the face price of the Ticket paid by the Customer shall be refunded by Pressoria to the exclusion of any other compensation or indemnity whatsoever.
Under these conditions, the refund shall be made upon written request by the Customer specifying the date on which he/she was unable to visit Pressoria, accompanied by any document justifying it, upon presentation of a bank statement and his/her Ticket. Prior to any refund, the Ticket shall be invalidated by Pressoria.
This request may only be made after the validity date of the Ticket. No refund will be made on the spot.

9.3 – PARTIAL OR TOTAL CLOSURE DURING THE VISIT

Pressoria shall not be held responsible in case of force majeure events disrupting the proper conduct of the visit of Pressoria and leading, if necessary, to its total or partial closure to the public. In this case, no refund will be granted.
The same shall apply if Pressoria is forced to close all or part of its premises for reasons of general interest, risk of serious disturbance of public order, risk to the safety of persons or property.

ARTICLE 10 – CONDITIONS OF ACCESS TO PRESSORIA

10.1 – RECEPTION AND VISIT MODALITIES

The Customer, with his or her Ticket, shall go directly to the Pressoria reception desk, during the opening hours specified on the Site.
Access to Pressoria is based on the reservation time indicated on the Customer’s ticket.
Depending on the number of visitors, Pressoria reserves the right to postpone the Customer’s access to the scenography if the Customer does not arrive at the time indicated (early or late) without reimbursement or compensation.
For events organized as part of cultural or gastronomic events, temporary and/or extraordinary to Pressoria’s activity, the event shall begin at the specified time. For technical or artistic reasons, latecomers cannot be guaranteed access to the rooms.

10.2 – TICKET CONTROL

Only the Ticket with a unique bar code is valid for access to Pressoria. All tickets are systematically checked at the entrance to Pressoria. This control is carried out by reading the bar code on the Ticket. In the case of an annual subscription, the Customer shall exchange the printed counterfoil for a name card at the Pressoria reception desk on his or her first visit to Pressoria (see Article 5.1). All tickets (full-price or discounted) may be inspected at the entrance to the premises, and proof of entitlement may be checked for discounted rates. In the event of non-compliance, the customer will be asked to pay the difference.

ARTICLE 11 – RESPONSIBILITY

The visit to Pressoria is made under the sole responsibility of the Customer.
The Customer shall be liable for any damage, direct or indirect, which it may cause, or which may be caused by persons or things in its custody, while on the premises of Pressoria, whether to the staff and/or customers of Pressoria or to any equipment made available to the Customer by Pressoria.
Pressoria shall not be liable if the non-performance or improper performance of its obligations under the General Terms and Conditions of Sale is attributable either to the Customer or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

ARTICLE 12 – SECURITY OF PAYMENTS

The Site is subject to a security system.
The BANCONTACT secure payment solution uses the SSL encryption process.
Pressoria guarantees that the encryption means, and services used to secure transactions have been authorized or declared in accordance with the legislation in force.

ARTICLE 13 – PERSONAL DATA

13.1 – CONSERVATION OF COLLECTED DATA

Pressoria undertakes to respect the confidentiality of the personal data communicated by the Customer and to process them in compliance with the French Data Protection Act (Loi Informatique et Libertés n°78-17 du 6 janvier 1978).
The data collected are the following: name, surname, date of birth, main postal address, e-mail address, telephone number, names and surnames of the participants, method of payment, country, the way in which the customer has known Pressoria, the need for an invoice.
This personal data is kept for the legal retention period relative to the purpose of the processing and for a maximum of three (3) years.
The personal data relating to the Customer’s bank card are kept only for the time necessary to complete the transaction.
The personal data necessary to send the newsletter are kept until the customer unsubscribes from the list of recipients.
The information and personal data transmitted to Pressoria by the Customer are subject to computer processing and may be used by Pressoria and its internal departments, subcontractors, partners or assigns, depending on the authorizations given by the Customer, for:

  • the processing, execution and management of Ticket purchases
  • processing requests for information and/or complaints,
  • informing the Customer of upcoming events,
  • improve and personalize the services that Pressoria offers to the Customer and the information that Pressoria sends to the Customer, in particular by sending information e-mails.

This information and data is also kept for security purposes, in order to comply with Pressoria’s legal and regulatory obligations.
Pressoria undertakes not to communicate information relating to the Customer to third parties other than its partners and subcontractors responsible for the management, execution, processing, payment and/or monitoring of Ticket purchases. Pressoria may, however, be required to disclose such data in order to comply with an order from the legal authorities.
Pressoria implements organizational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and Pressoria cannot guarantee the security of the transmission or storage of information on the Internet.

13.2 – RIGHTS OF THE OWNER OF THE COLLECTED DATA

In accordance with Article 34 of the French Data Protection Act updated by the European Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data; any Customer, providing proof of identity, may exercise his or her right to access, rectify and/or delete information concerning him or her and contained in Pressoria’s databases.
The Customer also has the right to limit the processing of his personal data, to erase, to port his personal data, to withdraw his consent as well as the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL). He may also object to his personal data being used for canvassing purposes and generally to the processing of his personal data for legitimate reasons.

He can give general or particular directives respectively to a trusted third party certified by the CNIL or to the person in charge of the treatment, relating to the conservation, the erasure and the communication of his personal data after his death. He or she may designate a person to carry out these instructions and may modify them at any time. In the absence of directives given during his lifetime, his heirs will be able to exercise certain rights, in particular the right of access.

ARTICLE 14 – MISCELLANEOUS PROVISIONS

14.1 – ELECTRONIC ARCHIVING

Pressoria archives orders and payment receipts on a reliable and durable medium constituting a true copy, in accordance with the legislation in force.
Subject to the application of any mandatory provision concerning the duration of the retention of consumer contracts (ten (10) years for contracts concluded by electronic means involving a sum equal to or greater than one hundred and twenty (120) euros in accordance with Article L 134-2 of the French Consumer Code), Pressoria shall retain such media for a period of three (3) years from the date of the Customer’s visit to Pressoria. Pressoria undertakes to ensure that the Customer has access to them at all times and to provide him/her with a copy of the General Terms and Conditions of Sale, if he/she so requests by writing to the following address Pressoria 11, Boulevard Pierre Cheval, 51160 AŸ-CHAMPAGNE
The computerized registers of Pressoria are considered by the Parties as proof of communications, orders, payments and transactions between them.
The Customer agrees that all correspondence and/or communication and/or transmission of information taking place with Pressoria by electronic means are presumed to have the same evidential value as a written document on paper.

14.2 – CUSTOMER SERVICE

For any information or question relating to Pressoria, the Customer may send :

14.3 – NULLITY

If one of the stipulations of the General Terms of Sale should be null and void according to a rule of law in force or a judicial decision that has become definitive, it will be deemed unwritten, without invalidating the contract or altering the validity of its other stipulations.

14.4 – MEDIATION

n the event of a dispute, the Customer has the possibility, before taking any legal action, of resorting free of charge to a conventional mediation procedure or to any other alternative dispute resolution method in order to seek an amicable solution.
In particular, the Customer may contact the consumer mediator to which Pressoria belongs, namely Voyages, tourisme.

14.5 – APPLICABLE LAW – DISPUTES

The sales of Tickets referred to in the General Terms and Conditions of Sale are subject to French law.
In the event of a complaint, the Customer may contact the customer service department whose contact details are set out in article 12.2 of the General Terms of Sale.
In the event of a dispute, the Parties shall refer the matter to the competent jurisdiction.

14.6 – ELECTION OF DOMICILE

For the execution of the present contract and the acts which would be the continuation or consequences, the Parties elect domicile as follows
For Pressoria: 11, Boulevard Pierre Cheval, 51160 AŸ-CHAMPAGNE.
For the Customer : At the address indicated at the time of the order.
